MANILA (Mabuhay) – President Benigno Aquino has appointed a Quezon City judge as the newest associate justice of the Court of Appeals to fill up the post vacated by Court of Appeals Associate Justice Amelita Tolentino.
According to the Supreme Court, Chief Justice Maria Lourdes Sereno received on Monday the appointment papers of Judge Germano Francisco Legaspi of the Regional Trial Court Branch 77.
Among the cases he handled was a review petition on a perjury case filed by cosmetic surgeon Vicki Belo against a former patient. He also handled a review petition filed by Marlene Aguilar-Pollard seeking to dismiss an obstruction of justice case against her.
Legaspi beat out fellow nominees Judge Geraldine Fiel-Macaraig of the Marikina RTC Branch 192; Judge Ronaldo Martin of the Antipolo RTC Branch 73; Judge Ruben Reynaldo de Guzman Roxas of the Manila RTC Branch 12; Judge Jeoffre Acebedo of the Cagayan de Oro City Branch 41; and Judge Perpetua Atal-Paño of the Makati RTC Branch 134.
The shortlist was transmitted to President Benigno Aquino III in October last year through a letter from Chief Justice Maria Lourdes Sereno, who is a Judicial and Bar Council ex-officio chair.
The JBC is constitutionally mandated to screen and vet nominees for vacant posts in the judiciary and the Offices of the Ombudsman and Deputy Ombudsman.
Joining Sereno in the seven-member JBC are ex-officio members Justice Secretary Leila de Lima (representing the executive department) and Aquilino Pimentel III (Congress), as well as regular members retired SC Associate Justice Angelina Sandoval-Gutierrez (retired SC justices), retired CA Associate Justice Aurora Lagman (private sector), Milagros Fernan-Cayosa (Integrated Bar of the Philippines), and Jose Mejia (academe).
