It seems Charlie Sheen’s Christmas Day assault on Brooke Mueller took more of toll on their marriage than anyone realized.

In divorce documents filed Monday in Los Angeles Superior Court, Sheen reveals that he and Mueller have been separated since Dec. 25, 2009, the day that he got arrested on domestic violence charges after allegedly pulling a knife on her. Sheen cites “irreconcilable differences” as the reason for the divorce.

According to the filing, the 45-year-old actor, who pleaded guilty in August to misdemeanor assault in exchange for probation and rehab, believes that any money he made after Dec. 25 belongs to him alone and isn’t subject to community property laws. That includes the last 10 months of pay from “Two and a Half Men.” Sheen reportedly makes close to $2 million per episode of the hit CBS sitcom.

The divorce filing details that Sheen and Mueller, 33, had a pre-nuptial agreement. To that end, Sheen claims “separate property” over everything he made prior to their May 2008 marriage.

Sheen is also asking for joint custody of the couple’s 18-month-old twins, Bob and Max. In a separate divorce filing, according to People magazine, Mueller asked for primary physical custody of the boys with visitation rights for Sheen. obtained a previous property settlement the couple signed in May in which Sheen agreed to pay Mueller $55,000 a month in child support. He also agreed to pay her $1 million to keep the couple’s home and an additional lump sum payment of $757,689.70.

Charlie Sheen Files for Divorce Number Three

Sheen’s third divorce comes on the heels of his alleged alcohol-fueled rampage at New York City’s Plaza Hotel. He underwent a psychological evaluation at a New York hospital following the Oct. 26 incident.

Christina Walsh, a 22-year-old porn star who was with Sheen during his hotel room blow-up, is reportedly planning to sue the actor claiming she feared for her life.
Sheen was at the hotel with his second ex-wife, Denise Richards, and their two children, Sam, 6, and Lola, 5. Richards and the children were staying in a separate room from Sheen. While Richards accompanied Sheen to the hospital, she has not revealed details about what happened that evening. A photo obtained by shows Richards and Walsh posing together, purportedly before the night went south.

Contrary to police reports, Sheen’s publicist maintains the actor was hospitalized not because he was drunk but because he was suffering an allergy to medication. While multiple media reports claim that Sheen, now back home in Los Angeles, is on the verge of another drug and/or alcohol induced meltdown, his team of handlers insists the actor’s A-OK.

“I went over to Charlie’s house earlier today because I was worried after reading RadarOnline,” his manager, Mark Burg, said in an e-mail statement distributed by Sheen’s publicist on Sunday.

Previously, reported Sheen was using cocaine.

“Complete bulls**t fabricated lies!!! Charlie was alone watching Brett Farve getting beat up by New England. He looked at me like I was nuts for coming into his house. ‘Dude, you could have knocked,’ he said. Charlie is fine and will be at work on Tuesday … Happy Halloween.”
